Legal penalties for service providers who do not meet standards in foreign substance injections

The Department of Health Service Support warns of the dangers of injecting substances or implanting foreign materials to enlarge the penis. There is a risk of harm from inflammation, infection from unclean equipment, and in some cases, it can progress to cancer requiring amputation of the penis.

Department of Health Service Support Warns

Dr. Sura Wisesak, Director-General of the Department of Health Service Support (DHSS), Ministry of Public Health, stated that following the case where DHSS, together with police officers and related agencies, arrested illegal doctors who secretly provided services injecting foreign substances and implanting foreign materials,

the recipients suffered from infections in the genital area, inability to control urination, and inability to have sexual intercourse. In the above case,

DHSS must clarify to the public that from the arrests of offenders in such cases over time, it was found that all providers injecting foreign substances or implanting foreign materials are not doctors.

They often use foreign substances that are not medically approved, such as vegetable oil, olive oil, or industrial silicone, injected under the skin of the genital area.

Effects of Using Foreign Substances

This causes chronic inflammation, swelling, redness, loss of elasticity, and contraction of the genital organ, making urination or sexual intercourse impossible. Additionally, there is a risk of pus infection and viral infections such as HIV (Human Immunodeficiency Virus).

Hepatitis viruses from unclean equipment or inflammation can progress to cancer in the genital area, necessitating amputation of the penis.

Offenses under the Medical Profession Act B.E. 2525

Dr. Phanuwat Panket, Deputy Director-General of DHSS, said that those who illegally practice medicine or act as illegal doctors will be considered offenders under the Medical Profession Act B.E. 2525, punishable by imprisonment for up to 3 years or a fine of up to 30,000 baht, or both.

Offenses under the Medical Facilities Act B.E. 2541

They are also guilty under the Medical Facilities Act B.E. 2541 for operating a medical facility without a license, punishable by imprisonment for up to 5 years or a fine of up to 100,000 baht, or both.

The Food and Drug Administration (FDA) Announces

Dr. Pathom Sawanpanyalert, Deputy Secretary-General of the FDA, revealed that following news reports about people receiving “Fresh Cell” injections hoping to treat cerebral artery stenosis but experiencing deterioration, the FDA has investigated the matter.

It clarifies that in Thailand, no drug formulation named “Fresh Cell” or products extracted from sheep placenta for injection have ever been registered. Therefore, if people want to inject such substances for any treatment, they should exercise extreme caution and not be misled by advertising claims.

These claims often come from animal cells, such as sheep, but the human body will mount an immune response against foreign substances, leading to allergic reactions. The severity varies by individual and can be fatal.

In some cases where “Fresh Cell” injections did not cause allergic reactions, it may be because the injected substance did not actually contain sheep placenta cells as advertised but was merely a processed substance. This could still pose long-term dangers as the exact substance is unknown and might act like growth hormones.

Dr. Pathom Sawanpanyalert further stated that using “Fresh Cell” or sheep placenta extracts for treatment in Thailand is illegal, punishable by imprisonment of up to 3 years or a fine of up to 5,000 baht, or both.

Advertising such drugs without permission carries a fine of up to 100,000 baht. Additionally, those injecting without being doctors violate the Medical Profession Act and Medical Facilities Act.

Operating a medical facility without a license is punishable by imprisonment of up to 3 years and a fine of up to 60,000 baht, or both. Practicing medicine without registration and permission is punishable by imprisonment of up to 3 years and a fine of up to 30,000 baht, or both.

However, in such cases, facts must be considered to determine if exceptions under the Drug Act apply, such as production under a licensed medical professional’s prescription for their own patients, which should be investigated by the Medical Council.

In the future, there may be specific legislation to control cells or stem cells to prevent harm from such medical services.
